Update on Bill Express court case

Hank Spier, legal counsel for the NANA initiated Class Action on Bill Express, has provided the following update on the action brought against the company by the ACCC.

There is a scheduling meeting in the Federal Court in Melbourne on 12 March. That will set the date for the trial.

Mobius and Bank of New York Trust have undertaken not to pursue any payments from newsagents until the Court action is over.

    They’ve been duped, they should be going after Ian Christianson and his cronies rather than innocent Newsagents.

    I thought the whole agreement was void seeing BE broke the contract.

    3000 individuals that own one business each, versus one entity under what? six business names that operated as one entity.

    I sold Optus recharge and paid BE, they didn’t pay Optus, Optus are 30M in the red.

    This is a no brainer, courts know no brainers gone wrong cause riots.

    There’s nothing left only junk technology, besides they would need a court order to remove it from every individual business What about the storage costs
    And why is Hank Spier scheduled a meeting anyway doesn’t seem necessary if there’s nothing left.

    Paul, The ACCC commenced action. This next meeting is ordered by the court as part of that action. The action is essential to stopping Mobius / Bank of New York going back to newsagents and getting the claimed payments.

    If whoever is acting for Bill Express comes to remove their junk electronic equipment from my store, they will be amazed at the rates of storage that I plan to charge….it should figure out at about the rate they were charging to have the stuff in my shop in the first place.
