Newsagent secures refund of Mobius deductions

A Victorian newsagent wrote to his bank a week ago seeking a refund of the funds taken from his account by Mobius for the Bill Express equipment. His letter sought the refund on the basis that the direct debit authority he signed for the Bill Express equipment was in favor of Technology Business International. Yesterday morning, checking his account, the newsagent found that his bank had refunded payments it has deducted without his authority since March this year.

This is a tremendous outcome.  Good on the bank for realising that it did not have the right paperwork to allow such a withdrawal.

    Thanks for the idea Mark.

    I have stopped the payments starting with the July deduction.

    I have just emailed my bank to see if they can recover the deductions for April to June, when the payments changed from Bill Express to CHP.

    Susan checked my bank a/c nothing taken thank god. Contact your bank and get it reversed they have to because you have not given them the authority in writing!

    I cancelled the direct debit from our account earlier this month which I paid for the cancellation to the bank as well, but still CHP debited that amount. how can I stop them to debit our account.

    Commonwealth. The Banks have a code of practice which you can draw to their attention.

    Last week I requested my bank to place a voluntry freeze on my account for withdrawals only starting from the 25-7-08 untill the 29-7-08. It takes a effort as to allow for other DD’s and outstanding cheques etc, but it appears to have worked. deposits can still be made, but no funds can be taken out. I will do this for the next month or two and base it around the 25th to the 29th and see what happens.

    Who do i actually have to name to the bank in regards to stopping the direct debits coming from my account, is it only CHP or is there any other names i have to give them?

    The loophole referred to at the top of this blog looks as though it has been firmly shut in our face. I tried to claim back the payments back to April by lodging a direct debit claim through my bank. Mobius or Perpetual proved to my bank that they had the proper direct debit authority including the letter TBI sent. Nice try. It was a long shot because I remember signing the authority and also I received the letter from TBI telling me they were changing the user id back in April.

    Mark, There are more newsagents who have been refunded by their banks. My understanding is that as the bank’s customer you have the right to cancel any direct debit authority. You could refer your bank to the Code of Conduct. mark

    mark i received all funding from from april thru till july which was was direct debited back,it takes 7 working days.great eh.thanks for help.

    today i tried to get my money back from suncorp that mobius had taken out over the 3 months , there reply was that it was my problem and that it was authorised .Has anyone had any success getting there money back from suncorp?

    I asked NAB to refund the money, and they refused. I then asked them to show me under what authority they withdrew the money. They have now refunded 2 months, and I am still chasing up the 3rd month.

    It might pay to try re-wording your query to ask them to prove it was a valid withdrawal.
